1. Introduction and Acceptance

Welcome to DailyFax! These Terms and Conditions ("Terms") govern your use of the DailyFax iOS application, website, and related services (collectively, the "App" or "Services") provided by Sylvonyx Technologies, Inc. ("we," "our," or "us").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Age Requirements

You must be at least 14 years old to create an account and use DailyFax. If you are under the age of majority in your jurisdiction of residence (e.g., 19 in South Korea or British Columbia), you may only use the App, and specifically make any in-app purchases or subscribe to premium services, with the valid and explicit consent of your parent or legal guardian.

3. Subscriptions and Payments

DailyFax offers premium content through auto-renewing subscriptions and one-time in-app purchases via the Apple App Store.

• Billing: Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Refunds: All purchases made through the App Store are subject to Apple's refund policies. Refund requests must be directed to Apple.

4. Virtual Currency, Items, and Consumables

The App features a virtual shop where you can acquire digital cosmetic items, consumable items (such as "streak restores"), and in-app virtual currency (such as "clips").

• No Monetary Value: Virtual items, consumables, and virtual currency within the App have no real-world monetary value and cannot be exchanged for cash, legal tender, or real-world goods. They are strictly limited to use within DailyFax.
• Limited License: You do not own the virtual items, currency, or consumables you purchase or earn. Instead, you are granted a limited, personal, non-transferable, non-sublicensable, revocable license to use them solely within the App.
• Modification Rights: We reserve the right to manage, regulate, modify, balance, expire, or eliminate virtual currency, items, and the shop catalog at our sole discretion, without liability to you.

5. User Accounts and Privacy

To access certain features, such as streaks, saving faxes, and the premium desk items, you must create an account via our supported authentication methods. You are responsible for maintaining the confidentiality of your login credentials securely.

We reserve the right to suspend or terminate your account at any time if we suspect a violation of these Terms. For information on how we collect and use your data, including integrations with Apple's CloudKit, please review our Privacy Policy.

6. Intellectual Property Rights

All content provided in the App, including but not limited to the daily faxes, idioms, example sentences, translations, graphics, and software code, is the intellectual property of Sylvonyx Technologies, Inc. You are granted a personal, non-commercial license to use the content for language learning purposes. You may not scrape, copy, modify, distribute, sell, or lease any part of our Services or included software.

7. Disclaimers and Limitations of Liability

Educational Content: The translations, idiom explanations, and educational materials provided in DailyFax are offered "as is" for informational and educational purposes. While we strive for accuracy, we do not guarantee the absolute correctness or completeness of the language nuances provided.

Service Availability: We do not guarantee continuous, uninterrupted access to the App. We are not liable for any lost data, missed daily streaks, or inaccessible content due to server outages, maintenance, or network issues.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in British Columbia.
